Fair Use Policy for the All Inclusive Shared Hosting Service
The present Fair Use Policy ("Policy") for the All Inclusive Shared Hosting Service ("Service") exists for the
purpose of protecting and supporting clients of the Service, for whom HOSTWAY strives to provide the best
operating conditions, while preventing that its network or other clients be in any way affected.
The following set of rules includes both client obligations concerning the legitimate use of the Service, as well
as examples of ways in which Hostway can intervene for preventing or limiting any possible damage.
1. The Service will be used solely for the hosting of small websites. A small website is defined as a simple
website, with under 100.000 pageviews per month and that doesn't need complex software or hardware configurations
of servers to run. This restriction is imposed by the fact that client applications must have a series of common
characteristics in order to be efficiently administrated. The decision if a site fits this description belongs
solely to Hostway. Its criteria will be detailed in Hostway product descriptions or offers.
2. Hostway will make all reasonable efforts to ensure a high quality of service for all clients, but reserves the
right to close contracts with those clients that, through the activity of the applications they host on the
Hostway Service or through their own action, of any kind, affect Hostway's capacity of providing quality
services.
3. The Service plans ("Plans") presented on the Hostway website represent methods of differentiating the Service
according to certain parameters, like the monthly number of pageviews. The technical characteristics of each of
these Plans do not represent guarantees for achieving a certain performance and they do not lead to technical
limitations. Their utility is to estimate the necessary amount of resources required to support a website, before
measuring its actual resource consumption.
For instance, if a website passes the number of indicated pageviews for its plan, this will not lead to extra
financial charges or activate technical limitations. The only aspect to be considered is that the quality of the
Service cannot be assured or controlled in these circumstances.
4. Hostway uses a system that allows the control of access rates to technical resources such as processor, RAM
and IO, which limits the degree of influence that one client's use of the Service can have over another's.
For instance, two clients using the same Plan will benefit, at the same moment of the same amount of processing
time, regardless of the number of requests from each of their applications. Similarly, a client who uses a Plan
created to support twice more pageviews, will have access to twice more resources.
If a client's application requires more resources for the processing of its requests, the time required for it to
answer will be longer. Hostway will ensure that this balance of resources between clients is respected but it
does not guarantee a certain level of performance, because the level of performance is directly dependent on the
client's application and, therefore, out of Hostway's control.
5. Hostway does not offer a mass-mailing service and it will allow the sending of mass emails only after the
acquisition of a dedicated IP, used for this purpose. If this IP enters anti-spam protection lists, the delisting
charge will be 100 EUR + VAT. If an entire class of IPs is entered on any of such lists, Hostway reserves the
right to terminate the client's contract and demand damage compensation worth 500 EUR, from the client.
6. Hostway will impose a series of limitations to the space a client can occupy on its servers, in order to
protect its infrastructure from automated scripts that can exist or be generated by a client's application and
which can affect the performance of a server; these limits will be raised following a written demand issued by
the client.
7. The following activities can lead to the termination of the contract:
- excess utilization of any kind of resources of the server for more than 3 days;
- storing files which have no connection with the hosted website or its functionalities, such as: personal
backups, video files, audio files, program kits, etc.;
- publishing materials that violate copyrights or laws;
- sending unsolicited emails in any quantity or with any content. If a complaint about such activity is received,
Hostway reserves the right to unilaterally decide on its validity and to take action by suspending the Service or
terminating the contract;
- sending commercial offers or information announcements with a frequency of more than 30 emails every 5 minutes,
with the exception of the situation where the client acquires a dedicated IP for this purpose;
- executing any type of illegal actions: phishing, cracks, serials, warez, virus propagation, botnets, utilizing
browser exploits, trojan applications, etc. There is no tolerance for these activities and the detection of this
type of behavior will consequently imply the involvement of the proper legal authorities for the investigation,
even before the client is notified;
- executing or using Bit Torrent type applications;
- executing activities such as Denial of Service attacks or using the Hostway services or network in any way that
can damage other persons or equipment;
- utilizing the service in order to make port scans or other invasive or non-invasive procedures on equipment
from the Hostway network or other networks.
In extreme cases or upon request from legal authorities, Hostway will immediately act to limit the impact on other
clients by suspending the Service or terminating the contract with the respective client.
8. Clients are not allow to resell Hostway services if a Reseller Agreement has not been signed between Hostway
and the client.
9. The client takes full responsibility for the applications he hosts on the Hostway Service.
The client will not involve Hostway in any way in transmitting materials which are disparaging, sexual, racist,
extremist according to the governing laws.
Hostway does not assume the obligation to monitor its clients for conformity with the present Policy.
10. Hostway encourages users who are affected by actions of Hostway clients that violate the present Policy to
send an email at abuz at hostway . ro mentioning every detail necessary to identify the client and describing the
results of the abuse.
11. If the present Policy is not respected, Hostway can:
- warn the client of the infringement via email;
- suspend the Service;
- eliminate the content that violates the Policy or the rights of other persons or governing laws;
- take any action necessary in order to prevent or limit damages.
